Since 2012, Home in Montreal
(9273-5885 Québec Inc.) offers short and long term furnished apartments
to international travellers and business people from around the world.
In Québec, short term rental (stays of less than 32 nights) is
legislated by the government and the CITQ (Corporation de l'Industrie du
Tourisme du Quebec). All our apartments are fully legal, this means we
have the CITQ permits, the adequate zonage, insurances, and that we pay
extra municipal taxes, lodging taxes (3.5%) and provincial (9.975%) and
federal (5%) sales taxes.
The following Terms & Conditions
are applicable on all bookings between Home in Montreal (“we", “us") and
our clients (“Guest(s)", “you") for the rental of fully furnished long
or short-term accommodations (“property").
1. Smoke free environment
Smoking
inside is strictly prohibited on all our properties. Smoking outside
(balcony / garden) is allowed and cigarette butts should be picked up
and disposed in the garbage bin or ashtray. All violation of the
non-smoking policy (including smoke odour) will automatically result in a
$500 penalty.
2. Pets
For hygiene and sanitary reasons, as
well as allergy reasons for other guests, no pets are allowed either
onto the grounds, nor inside under any circumstances. Any pets found in
accommodation properties will result in a termination of your booking
and additional cleaning charges.
3. Check-in / Check-out
Check-in
time is FROM 3:00 pm. Check-out time is UP TO 11:00 am. Early check-in /
late check-out is possible upon availability and subject to early
check-in / late check-out fees (contact us for more
information). It is essential you obtain our written consent and have
paid the according fee if you want an early check-in / late check-out.
4. Extensions
Extensions
cannot be guaranteed and are subject to other bookings in place, please
contact us for more information. All extensions of bookings must be
fully paid to be effective.
5. Keys
All instructions to
access the property will be indicated in the Guestbook you will receive
by email at the latest 1 week prior to check-in. If you have not
received our Guestbook, please contact us. Some properties have a keybox
with a “real key", others have a code or Smartphone Key entry. Any
lost keys are subject to a minimum 100 CAD + tax replacement fee.
6. Elevators and access ramp for people with reduced mobility
None
of our properties have an elevator and some properties have stairs.
Guests with reduced mobility should contact us before booking to inquire
about which property would fit their needs (best options should be Le
Garden Cottage, Le Laurier Cottage and Le Tierra).
7. Minimum age and responsibility of the person booking the property
You,
the person booking the property, must be at least 18 years old and must
possess the legal authority to create a binding legal obligation. All
information supplied by you on this Website is true and complete.
All
guests under 18 years old must be accompanied by an adult at all times
in the property. You will inform all other members of your party about
the Terms & Conditions that apply to the reservations you have made
on their behalf, including all rules and restrictions. It is your
responsibility to ensure that you and all the members of your party are
in possession of all necessary travel and health documents including
passports and visas (where applicable) before departure.
8. Care of the Property / Behaviour
You
should show respect and care for the property and its furniture,
fittings, facilities, effects and equipment and leave them in the same
state of repair, condition, cleanliness and general order as at the
commencement of the stay. Furniture should not be moved around. All
doors must be always locked when you are outside as well as inside the
property.
You are responsible for the correct and decent
behaviour of the members of your group. Should you or the members of
your party not behave in such a manner, fail to comply or with these
Terms & Conditions or in case of abuse to our staff or neighbours,
mistreatment of the property or criminal activity, Home in Montreal
reserves the right to ask you to leave the property without a refund.
We
allow only private / residential use and we do not allow loud parties,
social, business, trade events and other functions (shootings,
exhibitions, trade desks, weddings, large receptions, large cocktail
parties, etc.) on the property without our prior written consent.
9. Noise disturbance policy
We
expect all guests to have consideration and respect for the neighbours.
You should not create excessive noise at a level that disturbs
neighbors. Code-enforced neighborhood quiet hours are from 10:00p.m. –
8:00a.m. Loud music, parties or other gatherings that exceed the maximum
number of guests permitted are strictly forbidden.
Additional
charges or immediate termination (regardless of the time, day or night)
may apply in the event of excessive noise, nuisance or disturbance
caused to neighbours.
10. Cleaning fee
Each property will be
cleaned, prepared, reviewed for your arrival to welcome you in the best
condition. A professional clean will be carried out on check-out and the
cost is included in your total booking amount. We are happy to organise
mid-stay cleans or change of linen for you, at additional cost.
As
a respectful guest, you must leave the property clean throughout at the
end of the rental period. At check-out, you are obliged to leave the
apartment in perfect conditions, i.e. all waste should be correctly
disposed of and the apartment tidied. If a property is found to be left
in an unreasonable state at check-out, there may be excess cleaning
charges involved (hourly rate is 20 CAD + tax). This will be determined
on a case to case basis and a member of our team will contact the guest
to advise of the excess cleaning.
11. Complaints and problems
Every
effort is made to ensure the property is cleaned and in good order
prior to your arrival. In the unlikely event that you are disappointed
with the property or experience any problems, issues or damage, please
inform us immediately. We will endeavour to remedy any problem as
quickly as possible.
Any complaints received after your check-out
will not be accepted as it may be difficult for us to fairly
investigate your complaint thoroughly *a posteriori*. If you leave the
property before the end of your booking without authorisation by us, you
will lose the right for any refund or discount unless we have breached
the terms and conditions of this contract.
12. Damage deposit
A
damage deposit of 750 CAD is required 7 days prior to check in.
Breakages or damage to the property or its contents resulting from your
occupancy will be paid for by you and must be reported immediately to
us. In the event of damages incurred by you or your visitors to the
apartment or supplementary cleaning costs resulting from an insufficient
state of cleanliness, your credit card will be deducted with a charge
in accordance with the damages and a receipt will be forwarded to your
nominated email address. You will also be liable for any excess damages
(if the deposit does not reach to cover the costs, the due balance will
be charged to the provided credit card).
13. Cancellation Policy
Any notice of cancellation must be submitted by email. No cancellations or changes will be accepted by phone. As we incur costs from the time we confirm your booking and may be unable to re-sell your period of stay, the following cancellation policy will apply:
The cancellation policy that applies to your reservation corresponds to the policy in force on the booking platform (Website) with which you made your reservation, unless you have reserved directly on our Website (www.homeinmontreal.com), in which case the policy in force is the following:
**A 100% refund is provided for travellers cancelling at least 30 days in advance
**No refunds are provided to travellers cancelling less than 30 days prior to check-in.
If your arrival is delayed after the check-in date or you depart earlier than the check-out date no refund or amendment can be made to your original booking confirmation under any circumstances. We strongly recommend that you purchase adequate holiday cancellation insurance.
14. Changes and cancellation by us / Relocation
In
exceptional circumstances or cases of “force majeure" (for example
flood or fire), whether this happens before your check-in or during your
stay, we will contact you via e-mail and we will endeavor to offer you
another of our properties. If an alternative is of a lower price you
will receive a credit. If the price is higher we may not charge you at
our sole discretion, or you may be requested to pay an additional
amount. If you decline the alternative offer(s), we will offer you a
refund subject to the following conditions:
- 100% of the rental amount if you have not checked-in yet.
- The percentage corresponding to the days not used if the stay has already started.
We
regret we cannot pay any expenses, costs or losses incurred by you as a
result of any change or cancellation by us. Note that a cancellation by
us is extremely rare and unlikely.
15. Children policy
We
welcome families with children and babies. Children under 2 years old
stay for free if they share a room with an adult. A portable baby bed
can be provided if you request it and is available free of charge. As
parents, you are responsible for the respectful behaviour of your
children or the children of your guests visiting you in the property and
for the damage, be it voluntary or accidental, caused by them.
16. Number of occupants
Unless
otherwise agreed with us, only the number of people indicated on your
reservation at the time of booking shall be authorized to use the
property. If you wish to invite friends to visit you at the property,
you must first seek our written permission. If, without prior agreement,
the number of people occupying the property exceeds the number of
guests indicated on your reservation, you and all the members of your
party will be asked to vacate, with no refund made.
17. What is included?
Provided:
All properties are fully furnished to a high standard and include high
speed Wi-Fi Internet with unlimited connection, TV, air conditioning,
hairdryer, iron, linens, towels, a kitchen fully equipped with
appliances (including microwave, coffee-maker, toaster, electrical
kettle), cutlery, crockery, glasses and kitchen utensils. All properties
have a washer and dryer (except Le René Lévesque, Le St-Laurent and Le
Ste-Cath apartments which have a laundry room in the building) and all
properties have a dishwasher (except Le Ste-Cath, Le St-Denis, Le Boston
and Le Montréal apartments). A “starter kit" of toilet paper,
detergents and hand soap is provided. If you need more than the starter
kit, you need to purchase it on your end.
Should there be something missing, please do not wait to contact us so we can rectify the situation in a timely manner!
NOT
provided: Personal items (body soap, shampoo, toothpaste and brush,
face cloths), phone, food, gas for the BBQ tank if emptied.
Please
note that we cannot be held responsible for internet network
malfunctions nor with the possible incompatibility between your laptop
and our internet modem access.
18. Liability & Insurance
Neither
Home in Montreal, nor the owner of the property will be held
responsible for any direct or indirect damages caused to the property as
a consequence of the negligent use by the guest(s). This includes
damages, insurance, loss due to fire, theft, and misconduct.
One property (Le Tierra) have a fireplace but this
fireplace can **NOT** be used at anytime by the guest(s). The property
itself and its furniture and equipment are covered by insurance, in case
of fire, water leak and burglary or window glass breakages. Your
personal belongings, luggage, valued objects, personal civil injuries or
damages are **NOT** covered by the property insurance in any case. We
strongly recommend you to insure yourself, every member of your party,
your luggage and your party's luggage, cash, jewels, valuables, etc. by a
comprehensive travel insurance including also personal / civil
responsibility.
You, the guest(s), hereby acknowledge and agree
that the owner of the property, Home in Montreal or the members of it's
team will **not be held responsible nor liable for and will not pay any
compensation for**:
•Any personal injury, death, damage or loss
suffered by the guest(s) unless this results from the proven negligence
of the owner of the property, of Home in Montreal or our employee(s).
Please note it is your responsibility to show that there was negligence
on our end and that reasonable skill and care has not been used by us,
if you wish to make a claim. We are not liable for any personal
injury/death caused by the fault of the guest(s) (including inadequate
supervision of children), caused by the fault of a third party and/or
caused by an event that could not have been reasonably foreseen or
avoided.
•Any loss, breach or delay due to any cause beyond our
reasonable control including though not limited to act of God, war or
threat of war, riot, explosion, civil disturbance, terrorist activity,
natural or nuclear disaster, fire or accident, (snow) tempest, flood or
adverse weather conditions, strikes, lockouts, restrictions,
regulations, by-laws, or measures of any kind on the part of any
governmental or local authority, or other industrial actions or
disputes. In any such case of “force majeure", we shall be entitled to
treat the contract as terminated and we may, at our sole discretion and
on a case-by-case basis, refund the sums paid to us on a pro-rata basis
of used nights.
•Any noise, disturbance or inconvenience caused as a
result of renovation/building/road works being carried out in the
vicinity of the accommodation.
•Any breakdown of mechanical equipment
of the property, such as pumps, boilers, heater/air conditioning
systems, nor for failure of public utilities such as water shortages,
power cuts, TV or internet service out of order, etc.
19. Forgotten items
Please
make sure you have all your belongings when you leave as we accept no
liability for any personal items forgotten in our properties. If
something is left behind and our team finds it, we will be happy to mail
it back to you. A 50 CAD + tax (service charge) + shipping costs will
apply. We reserve the right to dispose of any unclaimed forgotten items
within 30 days of departure.
20. Right of Entry / Access
Whilst
respecting the reasonable privacy of the guest, we reserve ourselves
the right to access all properties at all times, if necessary, for
repairs, important maintenance work, inspection and emergencies. We will
make every effort to minimise any disruption to your stay.
21. Our Website / Copyright
The rates, descriptions, photos listed on our website are subject to change at any time and are indicate only.
Whilst
we do everything in our power to make sure that the photos and
descriptions listed on our website are correct and as accurate as
possible, you must accept that minor differences between the photos and
description used and the actual property may arise. We describe the
property and it's location to the best of our ability and in good faith.
We accept no responsibility or refunds for alleged misrepresentation.
Without
prior notice, we reserve the right to make modifications to the
property (change of furniture, fittings, amenities, facilities) that are
considered necessary or in the interest of continued improvement.
We reserve the right to update any of these Terms and Conditions at any time if it is deemed necessary.
The
entire contents of Home in Montreal's website (all photos, videos and
description texts) is the exclusively property of Home in Montreal and
protected by Copyrights. None of our website's content can be used or
sold for profit without our prior permission.
22. Personal data protection
We
use a Secure Sockets Layer (SSL), which is an Internet security
protocol used by Internet browsers and servers to transmit sensitive
information. (You can make sure you are on a SSL by checking the URL:
the http at the beginning of the web address should have changed to
https.)
In order to process your booking and to ensure that your
travel arrangements run smoothly we need to use the information you
provide such as name, address, etc. We take full responsibility for
ensuring that proper security measures are in place to protect your
information and we will not pass any information onto any person who is
not responsible for any part of your travel arrangements.
23. Law
All
contractual obligations arising out of these terms and conditions are
governed by the Province of Quebec and Canadian law. Any dispute
regarding your stay will be dealt with by the Province of Quebec or
Canadian courts.
